Privacy Policy

FENÊTRE À L’ART GmbH, Brückfeldstrasse 18, 3012 Bern, Switzerland (hereinafter referred to as "FENÊTRE À L’ART") is the author of the present Privacy Policy.

This Privacy policy applies to all services proposed by FENÊTRE À L’ART as well as to its users, physically on FENÊTRE À L’ART’s premises (hereinafter referred to as “Studio”) or on the online shop. The purpose of this Privacy Policy is to explain the nature, the scope and the aim of personal data collection, processing and management during the use of the above-mentioned services in conformity with the Swiss data protection legislation. 

Customers accept this Privacy Policy when they visit FENÊTRE À L’ART, either virtually through the online shop or physically at the Studio.

The applicable Privacy Policy is the current version, which is available on the FENÊTRE À L’ART online shop.

In case of doubt, the French version of the Privacy Policy shall prevail. 

Security of collected customer data

FENÊTRE À L’ART protects customer data by storing it on secure servers and applying appropriate security measures.

The data processed by FENÊTRE À L’ART and the computer systems that produce, process and save this data are protected against loss, destruction and manipulation, as well as against unauthorised access, modification and distribution, using appropriate technical and organisational measures.

Stored data and use

a) Payment for a session and/or purchase of gift vouchers in person at the Studio
In order to pay for a session or purchase a gift voucher at the FENÊTRE À L’ART Studio, the following data, including personal data, are entered and stored:

  • first name, surname
  • telephone number
  • e-mail address
  • information specific to the payment method used, except if payment is made in cash.

The data recorded is used for the provision of services and for communication between FENÊTRE À L’ART and its customers.

b) Booking of a session and/or purchase of gift vouchers via the online shop
In order to book a session or purchase a gift voucher via the FENÊTRE À L’ART online shop, the following data, including personal data, will be transmitted and stored after acceptance of the General Terms and Conditions and the Privacy Policy:

  • first name, surname
  • postal address
  • Telephone number
  • e-mail address
  • language of correspondence
  • information specific to the payment method used
  • IP address, sales channel, and date and time of registration, date and time of approval of the General Terms and Conditions (hereinafter referred to as “GTC”) and the Privacy Policy.

The data stored is used to log an electronic payment, to provide services, to enable FENÊTRE À L’ART to communicate with its customers and to improve its range of products and services.

c) Contact
FENÊTRE À L’ART may log the electronic and/or telephone exchange with customers, in particular for quality assurance, training purposes and/or to reconstruct the situation in the event of a complaint.

FENÊTRE À L’ART offers its customers various contact channels. If customers make personal data available for the purpose of using the service, this data will be recorded. 

d) Use of third-party products and services
FENÊTRE À L’ART works with third parties in various areas (e.g. payment processing), with whom customers enter into a contractual relationship that is independent of FENÊTRE À L’ART.

FENÊTRE À L’ART has no influence on the data collected and used by these third parties and refers to their Privacy Policies.

e) Browsing of the online shop
FENÊTRE À L’ART collects and uses data generated, transmitted or communicated by customers when browsing its online shop.

When customers use the FENÊTRE À L’ART online shop, cookies and other identification technologies are used, in particular to record user settings and to analyse these channels.

f) Newsletter
Customers may subscribe to FENÊTRE À L’ART's newsletter. By subscribing to the newsletter, customers consent to the processing of their data by FENÊTRE À L’ART for the purpose of implementing advertising measures, e.g. the sending of advertising e-mails or invitations to events and the distribution of personalised advertising.

FENÊTRE À L’ART is entitled to entrust third parties with the technical implementation of its advertising measures and to pass on customer data to them for this purpose. The customer's e-mail address will be used for advertising and marketing purposes unless the customer withdraws his or her consent. Customers may withdraw their consent at any time and simultaneously (compulsorily) unsubscribe from the newsletter by using the unsubscribe link at the end of each newsletter.

Disclosure of data to third parties for processing

FENÊTRE À L’ART is entitled to store and process customer data (including personal data) and to create data collections for the purpose of providing mutual contractual services and communication.

Personal customer data may not be traded.

FENÊTRE À L’ART communicates customers' personal data to third parties solely for the purposes of its business, as follows:

  1. at the request of customers
  2. to the Swiss authorities, in accordance with legal provisions or on the orders of the authorities
  3. in order to protect the legitimate interests of FENÊTRE À L’ART (e.g. where there is a risk of claims against FENÊTRE À L’ART by third parties or public authorities)
  4. in order to identify customers and respond to their requests when contacted via any of FENÊTRE À L’ART's communication channels
  5. for the promotion, design, improvement and development of FENÊTRE À L’ART's products and services
  6. for the purposes of the processing provided for in this Privacy Policy, insofar as FENÊTRE À L’ART does not undertake this itself.

If FENÊTRE À L’ART passes on customer data to third parties who process them on its behalf, it will ensure that these third parties process the data in exactly the same way as FENÊTRE À L’ART would do itself.

FENÊTRE À L’ART also transfers customer data to third parties located abroad. These countries are: Ireland, Canada, United States of America, Estonia, Denmark, Sweden.

Cookies and web analysis

The FENÊTRE À L’ART online shop use Google Analytics, a web analysis service provided by Google Inc (hereinafter referred to as "Google"), which relies on the use of "cookies".

The information generated by the cookie about your use of the FENÊTRE À L’ART online shop (including your IP address) is transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating the use of FENÊTRE À L’ART online shop by customers, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage in general.

Google may also transfer this information to third parties.

Customers may prevent the installation of these cookies by configuring their browser accordingly. In this case, they may not be able to use all the functions of the website.

Retention period

The duration data is kept depends on its intended use. Data is kept for as long as commercially necessary and appropriate.

Data that FENÊTRE À L’ART is required by law to keep for a certain period of time (e.g. obligation to document and keep accounting or tax records) will be kept for at least the period of time stipulated by the law.

Correction and deletion of personal data

Customers may request the correction/updating or deletion of personal data provided to FENÊTRE À L’ART at any time, provided that FENÊTRE À L’ART is not obliged to store such data due to legal requirements.

If customers wish to request the deletion of their personal data, they may do so by sending an e-mail to info(at)fenetrealart.ch, stating "Deletion of personal data" in the subject line and specifying their request. 

FENÊTRE À L’ART does not delete data which it collects and stores only in anonymised form and which can be associated with a person only with disproportionate effort.

Changes to the privacy policy

FENÊTRE À L’ART reserves the right to amend this Privacy Policy at any time. Amendments (including the withdrawal of rights and/or benefits) shall not give rise to any right of termination on the part of the customer.

Amendments will be duly communicated to customers through appropriate channels and will be deemed to have been approved by customers on the date of the communicated amendment.

FENÊTRE À L’ART has no control over changes to privacy policies of third parties and does not notify customers in the event such a change occurs.
